1. About These Provider Terms
These Provider Terms are issued by Guide Assist (ABN 70426075664) (we, us, our) and apply if you are a service provider seeking to be listed, displayed, or contacted through the Guide Assist platform, or if you submit provider information through our platform (for example via intake forms).
These Provider Terms apply together with our Privacy Policy and Disclaimer & Safety Notice. End-users of the platform are also subject to our User Terms.
If you do not agree to these Provider Terms, you must not submit a listing request or provider materials for publication on Guide Assist.
2. Provider Independence
You are an independent third party. Nothing in these Provider Terms creates an employment, partnership, agency, franchise, brokerage, or managed-service relationship between you and us.
You are not an employee, agent, contractor, affiliate, partner, representative, or managed service provider of Guide Assist unless expressly stated otherwise in a separate signed agreement.
3. What Guide Assist Is (Platform Role)
Guide Assist is an independent digital discovery and connection platform that provides general informational tools, digital search functionality, communication tools, and optional AI-assisted informational features to help users explore and contact independent third-party service providers.
4. No Endorsement
Guide Assist is not an accrediting authority. Listing or display on Guide Assist does not mean we certify, endorse, recommend, approve, guarantee your holistic regulatory compliance, guarantee that NDIS registration stays current after listing, assure provider quality or safety, assess suitability for any user, undertake ongoing monitoring of providers, guarantee your availability, guarantee your insurance arrangements, independently verify qualifications beyond such limited comparisons as stated below, or treat any registration label displayed on the platform as a substitute for participant due diligence or official NDIS sources.
Guide Assist may conduct limited administrative checks of provider-submitted business and claimed registration information using publicly available sources, including comparing provider-submitted claimed registration information against the public NDIS Commission provider register, at or around listing time.
Those comparisons are limited administrative checking only, use public sources available at or around listing, snapshot-based where applicable, intended to identify obvious inconsistencies with publicly published register information rather than certify providers — and they are not endorsement or certification, not suitability assessment, not quality or safety assurance, not ongoing monitoring, not a holistic compliance audit or regulatory assurance about your services generally, not a promise that registrations or other details remain current after listing, not a substitute for enquiries with the NDIS Commission or other official registers, and may be incomplete due to reliance on publicly available publication timing and completeness.
Guide Assist does not assess, recommend, endorse, supervise, manage, guarantee, verify suitability (as an assessment service), or determine whether any provider is appropriate, safe, qualified, suitable, or fit for a user’s circumstances.
5. Search Results and Ordering
Any sorting, filtering, grouping, or ordering of results is provided for informational convenience only and does not constitute endorsement, recommendation, quality assessment, or suitability determination.
6. Listing Accuracy
You must ensure that all information you provide about your business and services is accurate, not misleading, and kept up to date (including where applicable business identity, service areas, registration or scheme participation statements, and contact details).
You must promptly notify us of material changes that affect your listing.
7. Provider Compliance
You are solely responsible for complying with all laws, regulations, professional obligations, insurance requirements, and NDIS-related obligations that apply to you and the services you deliver.
Guide Assist does not supervise how you deliver services to clients or participants.
8. No Guarantee of Enquiries, Ranking, Visibility, or Outcomes
We do not guarantee any minimum number of enquiries, any particular ranking or ordering, visibility, impressions, leads, revenue, or business outcomes. Platform features and algorithms may change over time.
9. Administrative Review of Listings
Where we offer listing submission, we may apply administrative review for completeness, formatting, spam prevention, compliance with Guide Assist listing requirements, comparison of provider-submitted claimed NDIS registration-related information against the public NDIS Commission provider register at or around listing time, assessment of openly available business-identification identifiers you supply (such as Australian Business Number) only for reasonably consistent inclusion in listing administration, and other limited checks using comparable publicly published sources reasonably necessary for straightforward listing consistency.
This process remains administrative only and snapshot-based — it does not certify providers or registration claims for all contexts, ascertain suitability or safety outcomes, constitute ongoing audits of qualifications or compliance, convert listing administration into an exhaustive suitability assurance or holistic compliance certification process about your services generally, or confer fitness for purpose for participants.
10. Permission to Use Provider Content
You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and communicate the text, logos, images, and other materials you provide for the purpose of operating, promoting, and improving the directory and related platform features.
You represent that you have the rights needed to grant this permission for the materials you submit.
11. Acceptable Conduct
You must not:
- submit false, misleading, or deceptive listing content
- use the platform to harass, discriminate against, or exploit users
- misuse personal information received through user enquiries
- attempt to manipulate listings through fraudulent reviews, impersonation, or technical abuse
12. Privacy Expectations When You Receive Enquiries
If you receive personal information about a user because they chose to contact you via the platform, you must handle that information lawfully and only for the purpose of responding to the enquiry and providing your services, unless you obtain further consent where required.
13. Complaints
Users may contact us about listing concerns. We may ask you for information reasonably necessary to understand a complaint. You agree to cooperate in good faith where reasonable.

14. Suspension and Removal
We may suspend, hide, or remove a listing, or restrict provider features, where we reasonably believe you have breached these Provider Terms, created a safety or legal risk, engaged in misleading conduct, or where required by law. We may also remove content that does not meet listing requirements after reasonable notice where appropriate.
15. Future Paid Features
Guide Assist may introduce optional paid features (for example enhanced profiles or tools). If fees apply, they will be presented separately and must be accepted before you are charged. Paid features do not change the independence and no-endorsement framework in these Provider Terms unless expressly stated at the time of purchase.
16. Liability
To the maximum extent permitted by law, we are not liable for loss arising from your services, your interactions with users, reliance on listing content you supplied, or business outcomes, subject to the paragraphs below.
Nothing in these Provider Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law.
17. Changes
We may update these Provider Terms by posting a revised version with an updated date. Continued submission of listing information or continued participation as a listed provider after changes may constitute acceptance of the updated terms, subject to applicable law.
18. Governing Law
These Provider Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales, subject to any mandatory laws that apply to you.

20. Provider Acknowledgement (Recommended Wording)
Where we collect acceptance through a form, you may use wording substantially like the following next to your acceptance control:

I confirm my listing information is accurate to the best of my knowledge and I will comply with applicable laws.
