User Terms

1. About These User Terms

These User Terms apply to your access to and use of the Guide Assist website, digital tools, and related features operated by Guide Assist (ABN 70426075664) (we, us, our).

By accessing or using the Guide Assist platform, you agree to these User Terms and acknowledge that you have read our Privacy Policy and Disclaimer & Safety Notice. If you do not agree, you must not use the platform.

2. Who These Terms Apply To

In these User Terms, you and your means any user of the platform, including (without limitation) NDIS participants, families, carers, supporters, support persons, providers browsing as users, and other visitors.

If you use Guide Assist on behalf of another person, you represent that you are authorised to do so and that you will ensure they understand these documents.

3. What Guide Assist Is

Soft launch notice: Guide Assist is currently in a soft-launch testing phase. Features, processes, and documents may be updated as the platform develops.

Guide Assist is an independent digital discovery and connection platform that provides general informational tools, digital search functionality, communication tools, and optional AI-assisted informational features to help users explore and contact independent third-party service providers.

The platform may include educational information about the NDIS and related topics; Guide Assist is not the NDIA, NDIS, or a government service.

5. Independent Providers; No Recommendation

Providers listed, displayed, or discoverable through the platform are independent third parties and are not employees, agents, contractors, affiliates, partners, representatives, or managed service providers of Guide Assist unless expressly stated otherwise in a separate written agreement between you and us.

Guide Assist does not assess, recommend, endorse, supervise, manage, guarantee, verify suitability, or determine whether any provider is appropriate, safe, qualified, available, compliant with NDIS or other applicable laws in any overall regulatory sense attributable to Guide Assist, or fit for your circumstances.

At or around listing time Guide Assist may, for qualifying provider listings described in our Provider Terms, conduct limited administrative checks that compare provider-submitted business information and NDIS registration-related claims against publicly published sources — including comparing claimed registration-related information against the public NDIS Commission provider register. These checks snapshot publicly available listing-time information only; they do not certify providers, constitute endorsement or suitability assessment, assure quality or safety, conduct holistic regulatory audits, provide ongoing monitoring after listing, guarantee that registrations or particulars remain accurate or current afterward, or replace your obligation to independently verify matters that matter for your circumstances.

You are solely responsible for independently evaluating, selecting, contacting, and engaging providers.

6. Search Results and Ordering

Any sorting, filtering, grouping, or ordering of results is provided for informational convenience only and does not constitute endorsement, recommendation, quality assessment, or suitability determination.

7. AI-Generated Content

Where the platform offers AI-assisted features, AI-generated content is automated informational content only and may be incomplete, inaccurate, outdated, inappropriate, or unsuitable. AI output is not a substitute for professional advice. You must not rely on AI output as advice about your health, finances, legal rights, eligibility, or personal circumstances.

Automated Translation, Multilingual Content & AI Output

The platform may display automated translations of chatbot responses, interface text, legal notices, and other content, and may use automated systems (including AI-assisted features) to support multilingual accessibility and convenience. By using these features, you acknowledge they are provided for accessibility and convenience only and are not a substitute for professional advice, official NDIS or NDIA communications, or your own independent verification.

Translated or multilingual content may contain inaccuracies, omissions, contextual differences, simplifications, delays, or altered meaning. The same concept may be expressed differently between languages, and translated wording may not carry the same legal, technical, or practical effect as the original.

Where any difference arises in wording, interpretation, or effect between a translated version and another version (including content shown in another language), the English-language version is the primary reference version to the extent permitted by law, unless an official government publication in another language is expressly identified as authoritative for that specific matter.

You must independently verify any information that is important to your circumstances. For authoritative NDIS scheme information, decisions, policies, forms, and updates, you should check official NDIA and NDIS sources (including ndis.gov.au and other official channels) and obtain advice from qualified professionals where appropriate.

Guide Assist does not guarantee the accuracy, completeness, currency, legal equivalence, cultural appropriateness, or suitability of any translated, multilingual, or AI-generated content. Guide Assist is an independent platform and is not the NDIA, NDIS, or a government service.

Without limiting your responsibilities elsewhere in these User Terms, you must not rely on translated or AI-generated content alone when assessing matters such as:

To the maximum extent permitted by law, Guide Assist is not liable for any action, decision, misunderstanding, loss, damage, cost, dispute, regulatory issue, or compliance issue arising from your reliance on, or use of, translated content, multilingual features, or AI-generated output—including where you act (or fail to act) based on translated chatbot responses or translated interface or legal text.

Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.

8. Privacy

Our handling of personal information is described in our Privacy Policy, which should be read alongside these User Terms.

You should avoid entering unnecessary sensitive personal, medical, financial, or identification information into chat features or forms.

9. User-Initiated Contact

Where the platform enables you to send an enquiry or message to a provider, that disclosure occurs based on your choice of recipient. Guide Assist provides communication tools; it does not select providers on your behalf.

We may modify, suspend, or discontinue any part of the platform at any time, including for maintenance, updates, improvements, or security reasons. We do not guarantee uninterrupted, error-free operation or compatibility with every device or browser.

The platform may link to third-party websites or tools. We do not control third-party content, terms, or privacy practices. Your use of third-party services is at your risk.

13. Intellectual Property

Unless otherwise stated, we own or licence the rights in platform content, branding, layout, and materials. You may browse and use the platform for personal, non-commercial purposes subject to these User Terms. You must not copy, scrape, or commercially exploit our content without consent, except as permitted by law.

14. Liability

To the maximum extent permitted by law, we are not liable for loss or damage arising from your use of the platform, your reliance on platform content or AI output, or your interactions with providers, including indirect or consequential loss where such exclusion is permitted.

Nothing in these User Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law.

15. Emergency and Crisis Situations

The platform is not designed for emergencies. If you or someone else is in danger or needs urgent help, call 000 or contact appropriate crisis services (for example, Lifeline on 13 11 14).

16. Termination of Access

We may suspend or restrict access to the platform where reasonably necessary to address unlawful use, abuse, security risk, or harm to users or third parties.

17. Governing Law

These User Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales, subject to any mandatory laws that apply to you.
